<rss version="2.0"><channel><title>Digital Artistry Info Latest Topics</title><link>https://digital-artistry-online.com/forum/109-digital-artistry-info/</link><description>Digital Artistry Info Latest Topics</description><language>en</language><item><title>Who owns the Copyright on Scrapbooking Pages?</title><link>https://digital-artistry-online.com/topic/1031-who-owns-the-copyright-on-scrapbooking-pages/</link><description><![CDATA[<p>As this question has come up a few times, and someone told me they are not sure what names to put into the "copyright" field when they load a page in the gallery, I thought I post this brief summery here in case it's useful information for you as well. <br>However, please note I am no lawyer nor copyright expert, and different countries may have slightly different copyright laws, so this is in no way legal advice, it's just an attempt to explain things in a nutshell. <br><br>When you create a digital scrapbooking page using a digital scrapbooking kit made by a designer and photos taken by someone else than you, the copyright ownership can be really complex and generally breaks down as follows:</p><p>   <strong> Digital Scrapbooking Kit:</strong> The original creator of the kit holds the copyright to the design elements they created (graphics, embellishments, backgrounds, etc., if they used commercial use items not created by them, then the copyright is held by the original creator of these items and they would have a license to use these items in their products and sell those end-products to you). <br><u>You</u> typically just have a license to use these items, often limited to personal use unless otherwise specified. You do <u>not</u> own the copyright to the kit contents themselves. When publishing layouts anywhere, you should always give proper credit with the designer name and product name of the products you used written out whenever possible as noted on the product preview or the product's terms of use.</p><p>    <strong>Photos taken by someone else than you: </strong>The photographer owns the copyright to the photos. You may have permission or a license to use the photos, but you do <u>not</u> own them. You should never use any photos you don't know the copyright owner is ok with you using them for that purpose/if you don't have obtained a license to use them.<br>There are a few exceptions:<br>- Photo was taken as part of employment/contract (the employer or the party who commissioned the work typically owns the copyright, not the photographer)<br>- Copyright was legally transferred or assigned to another person through signed agreement<br>- Photo was created by a government employee as part of their official duties (depending on the country’s laws), the photo might be in the public domain, meaning <u>no one</u> owns the copyright. Only sufficiently original, new derivative works based on/created with those materials can be copyrighted again.<br>- Photographer licensed their photos exclusively to an agency or client, effectively restricting their own rights or transferring certain rights.</p><p>    <strong>Your Digital Scrapbooking Page:</strong> The new page you create is a derivative work that incorporates copyrighted elements from others. You own the copyright to <u>your original contributions to the page only</u> (such as the creative arrangement, any personal journaling, or original artwork you created yourself like design elements you created or photos you have taken yourself), but the page as a whole is still subject to the copyright restrictions of the original kit and photos created/taken by others.</p><p>In summary, you own the copyright only in the original content and creative arrangement <u>you</u> created and added. The underlying copyrighted elements remain owned by their respective creators, and your use of them is governed by the licenses or permissions you have (for example by purchasing a product). If you want to distribute or even monetize your scrapbooking page, you must ensure your use complies with the licenses of the kit and photos.<br><br>This is generally true to most created content.
